CSR-1 Registration

An Overview

 

 

Every NGO or Non Profit Organization or any entity (Section 8 company/ Registered Trust/Registered Society) who are undertaking CSR activities or wants to undertake CSR activities are now required to be registered with Central Government by filing an electronic Form CSR-1.

 

The companies can now allocate their CSR funds to only those entities who are registered with MCA.

 

The Form CSR-1 needs to be certified by the Chartered Accountant in practice or a Company Secretary in practice or a Cost Accountant in practice

 

On the submission of the Form CSR-1 on the portal, a unique CSR Registration Number shall be generated by the system automatically.

 

 

Law governing the eForm CSR-1

 

 

CSR-1 forms is governed by section 135 of Companies Act, 2013 and the Companies (Corporate Social Responsibility Policy) Rules, 2014 and Companies (Corporate Social Responsibility Policy) Amendment Rules, 2021.

Who are eligible for filing Form CSR-1?

 

 

1. A company established under section 8 of the Act, or a registered public trust or a registered society, registered under section 12A and 80 G of the Income Tax Act, 1961 (43 of 1961), established by the company, either singly or along with any other company, or

 

2. A company established under section 8 of the Act or a registered trust or a registered society, established by the Central Government or State Government; or

 

3. Any entity established under an Act of Parliament or a State legislature; or

 

4. A company established under section 8 of the Act, or a registered public trust or a registered society, registered under section 12A and 80G of the Income Tax Act, 1961, and having an established track record of at least three years in undertaking similar activities.

 

 

 

What are CSR Activities and Funding?

 

CSR Activities are those activities which are defined under Companies Act, 2013 and COMPANIES (CORPORATE SOCIAL RESPONSIBILITY POLICY) RULES, 2014 to be undertaken by prescribed companies by itself or through any other prescribed entities by giving them CSR funds.

Process for Filing Form CSR-1

 

  1. The applicant needs to download the form from MCA Website for which the direct link is: Ministry Of Corporate Affairs - Forms & Downloads (mca.gov.in)
  2.  
  3. After Downloading the Form, the details as required in the form shall be filled.
  4.  
  5. The Documents as required will be attached to the Form
  6.  
  7. The Form then needs to digitally signed by the Director or Authorized Representative of the Applicant.
  8.  
  9. After it is signed by the applicant, it is to be Certified by the CA/CS/CMA in practice.
  10.  
  11. Once the form is certified, it will then be uploaded to MCA Website
  12.  
  13. After successfully upload a unique CSR registration number shall be allocated to the Entity and the Entity will then be registered as an Entity for accepting CSR funding.
